SEWING EQUIPMENT RENTAL: TERMS, CONDITIONS AND LIMITATION OF LIABILITY

As the person signing below (the “Renter”), Renter understands and agrees that this agreement (the “Agreement”) sets out the terms, conditions and limitation of liability of Renter renting certain sewing equipment from Cut Twice (“Cut Twice”), a division of Form Era Studio Ltd.

1. Renter Eligibility

  • Minimum Age: Renter must show proof of being at least 18 years old.

·        Skill Level: Renter confirms Renter is trained and competent to use the Sewing Equipment.  Renter will follow all posted rules and will maintain a clean workspace.  Renter will also immediately report any unsafe conditions or equipment issues.

 

2. Sewing Equipment, Rental Period, Usage and Damage Deposit

  • Sewing Equipment: The sewing equipment (the “Sewing Equipment”) is as listed and agreed at online booking time (Shopify website).
  • Rental Term: The rental period begins and ends based on booking time through online booking portal at www.cuttwicetoronto.com.   In the event that the Sewing Equipment or tool is not operational at the time of booking, Cut Twice will issue a refund to Renter.

·        No Subletting or Assignment: Renter may not sublet, assign or transfer this Agreement without the prior written consent of Cut Twice

 

3. Appropriate Use

·       Mandatory Tutorial Instruction from Cut Twice: Renter understands that Cut Twice offers mandatory Sewing Equipment, machine safety and operation tutorials at time of first rental, and that Renter use afterward will be self-guided. Renter will use only the Sewing Equipment they have been trained on and will follow all safety practices.

·       Safe and Proper Manner: Renter agrees to use the Sewing Equipment in a safe and proper manner at Cut Twice’s studio premises.

  • Renter Responsibility: Renters are responsible for operating the Sewing Equipment under reasonable conditions (i.e., not forcing operation through jams or inappropriate materials), and keeping the machine clean.
  • Damage and Wear: Renters are liable for any damage occurring outside of ordinary wear and tear, and will be charged for repairs or excessive cleaning through deductions from the $75 security deposit, with charge amount being at Cut Twice’s sole discretion.

 

4. Deposits, Cancellations and Fees

  • Deposit: A full payment is required to secure the reservation.

·        Damage Deposit: A security deposit of $75 is charged with each rental.  Cut Twice will refund the security deposit at the end of rental period if the Sewing Equipment and tools are returned in good working order. If the Sewing Equipment or tools are deemed to have been damaged through misuse, Renter waives the right to the security deposit. Return of the security deposit is at the sole discretion of Cut Twice as owner of the Sewing Equipment and tools.

  • Cancellation Window: Cancellations must be made at least 48 hours prior to the booking start to avoid penalty charges. Cancellations done within 48 hours of rental will not be refunded.
  • Late Returns: Sewing Equipment used past the agreed-upon time will incur additional fees, equal to additional rental time. Use past booking time will not be permitted if the machine has been booked by another user.
  • Service Interruption: In the event that the Sewing Equipment or tool is not operational at the time of booking, a refund for unused time will be issued to Renter.

 

 5. Maintenance, Damage and Liability

  • Renter Assumption of Risk: Renter acknowledges that use of the Sewing Equipment contains risks, including but not limited to injury or death.  Renter accepts responsibility for all risks and damage caused by mechanical failure and Renter misuse or negligence.  Cut Twice is not responsible for Renter’s lost, stolen or damaged personal belongings.
  • Limitation of Liability: Limitation of liability: Renter agrees to release, waive and discharge Cut Twice from any claims which result from Renter’s actions or use of the Sewing Equipment.  To the fullest extent permitted by law, Renter releases, waives and discharges Cut Twice, its owners, officers, directors and affiliates (collectively, the “Released Parties”) from any and all liability, claims, injury or damages arising from Renter’s use of the studio and the Sewing Equipment.
  • Indemnification: Renter agrees to indemnify and hold harmless the Released Parties from and against all claims, demands, liabilities, losses, damages, serious bodily injury, costs and expenses (including legal fees) arising out of or related to Renter’s use of the Sewing Equipment, whether or not such damage or injury occurs directly or indirectly as a result of Renter’s use of the Sewing Equipment, including but not limited to any claims for personal injury or property damage.
